The Pennsylvania State Police (hereafter known as "State Police") provides this Electronic Notification System (“System”)
to you subject to the following Terms of Service ("TOS"), which may be updated from time to time without notice to you.
By completing the initial sign-up process for the System you expressly understand and agree to the terms of the TOS.
The purpose of the System is to provide you with electronic mail (“email”) notifying you whenever a registered sexual offender moves the location where they live, work or
go to school, if that move is into or out of any location within up to a five miles radius of an address you sign up to
monitor. In the case of a transient, registered sexual offender, you will receive electronic mail (“email”) notifying you
whenever the transient, registered sexual offender moves the location where they will be located, work or go to school, if that
move is into or out of any location within up to a five mile radius of an address you sign up to monitor. You may sign
up to monitor a total of five separate addresses at any one time. Also, this System will enable a user to monitor / track
a specific sexual offender and receive corresponding notification(s) when certain changes occur for the sexual offender on the
website. The System is provided to you as a member of the public with the intent of providing you access to information
regarding individuals registered as sex offenders with the State Police pursuant to 42 Pa.C.S. §§ 9799.10-9799.41
(Pennsylvania’s Megan’s Law). This information is provided so you can take steps to ensure the personal safety of you,
your family and the community.
The System will provide users with the ability to receive email messages generated by the State Police. In order to use
the System, you must have a valid email address and access to the World Wide Web. YOU are responsible for any fees and
equipment required for you to access the World Wide Web.
The information that you are able to access via the System is based largely on self-reported address and location
information provided by registered sexual offenders; therefore the System may not include accurate location information
for registered sexual offenders who have provided false information or are otherwise not in compliance with the applicable
provisions of Megan’s Law. Additionally, information displayed on the mapping component of the State Police public Megan’s
Law Website is based on available Geographic Information Systems (GIS) data and represents only approximate locations. You
understand and agree that the System is provided "AS-IS" and that the State Police assumes no responsibility for the timeliness,
deletion, misdelivery or failure to store any user communications or personalization settings or for the accuracy or timeliness
of offender information that is noncompliant or falsely or untimely reported to the system by the offender. Likewise, you
agree that your use of the System is at your own discretion and risk and that the State Police is not responsible for any
damage to your computer system or loss of any data that results from any information or material you access or download
through the use of the System.
The purpose of the System is not to enable you or others to threaten, intimidate or harass a registered sexual offender
or members of their household or family. Misuse of the System to threaten, intimidate or harass a registered sexual offender
or members of their household or family may subject you to criminal prosecution and civil liability as well as subject your
System account to termination. You agree to indemnify and hold the State Police and its servants, agents and employees,
harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of
information you obtained from the System, your use of the System, your connection to the System, your violation of the TOS,
or your violation of any rights of another.
The State Police, in its sole discretion and without prior notice, may terminate your password, account or use of the
System, for any reason, including, without limitation, for lack of use or if State Police believes that you have violated
or acted inconsistently with the letter or purpose of the TOS. Further, you agree that the State Police, and its servants,
agents and employees, shall not be liable to you or any third-party for any termination of your access to the System.
NOTE: Sometimes the system will be unable to determine the exact location of the address submitted
by the offender. If the system is unable to identify the exact location, it may create a pin to identify
offender addresses based on an approximate location determined by the city, zip, street/intersection or
